Terms of Service (TOS)

Customer agrees that when using or accessing FastCloud services, the terms and conditions of this policy will be met:

  • User agrees to use the service in a manner consistent with any and all applicable laws. In the event that this account is not used in accordance with all Applicable Laws, including, but not limited to, Local, State, or Federal Laws, FastCloud reserves the right to cooperate with all or any law enforcement agencies.

  • User agrees to follow the Acceptable Use Policy of any network user connects to, including the FastCloud system.

  • Neither FastCloud nor its Information Providers are responsible for any damages arising from User’s use of FastCloud or by User’s inability to use FastCloud service.

  • User hereby agrees that any material submitted for publication on FastCloud through user’s account(s) does not violate or infringe any copyright, trademark, patent, statutory, common law, or proprietary rights of others, or contain anything obscene or libelous. Users may not host any hardcore adult content or porn websites on our servers. Software intended to facilitate any such violations or infringements may not be stored on FastCloud.

  • Violations of “netiquette,” such as posting off-topic articles to excessive numbers of newsgroups or sending unsolicited mass emails, are grounds for suspension pending investigation by FastCloud and may result in account termination.

  • FastCloud prohibits usage of IRC and associated programs, scripts for abuse, attacks, or flooding, and unauthorized proxies are strictly banned.

  • Users whose accounts are terminated for any of the above infractions are responsible for the cost of labor to clean up and respond to complaints incurred by FastCloud.

  • User agrees not to use excessive amounts of resources. Violations may result in corrective actions to maintain server stability, which may involve terminating processes or suspending the account.

  • User may not exceed 100% CPU usage out of 1 CPU Core, limited to 1 CPU core, 1GB memory, 1024 Kbps IO, 100 NPROC, or 20 Entry Processes. Cron jobs must not execute more than once every 30 minutes unless specified by the script provider.

  • If it is determined that a customer’s account is overusing system resources, FastCloud may temporarily suspend the account to prevent server issues. Users may be advised to upgrade to a Premium Hosting Plan, VPS, or Dedicated Server if the shared environment is unsuitable.

  • FastCloud performs daily or weekly backups on accounts under 20GB and 150,000 Inodes. Users are responsible for their data and encouraged to maintain their backups. FastCloud is not liable for data loss.

  • The use of more than 50,000 inodes on any cPanel account may result in warnings and potential suspension if limits are exceeded. Reseller accounts have additional inode considerations.

  • Users must not offer free services like web hosting or email without prior consent. Violations may result in immediate suspension.

  • File hosting and storage services are strictly prohibited on shared and reseller servers. Hosting is intended solely for websites, not for file repositories.

  • Abuse of FastCloud staff or support personnel, including using demeaning or rude language, may result in account suspension and request for business termination with notice.

Payment Issues:

  • User agrees to pay FastCloud all charges according to rates and prices stated at the commencement time.
  • FastCloud reserves the right to suspend service access upon credit issues, including delinquent payments.
  • Supports automatic credit card billing on the due date.
  • Late payment may result in service suspension, termination, and data erasure after specified durations.

Public Feedback:

  • Posting public negative feedback before contacting FastCloud’s “Suggestions & Complaints” Department may result in account termination.

Refunds:

  • FastCloud offers a 30-day money-back guarantee on first-time hosting service fees. Refunds for further orders or changes are not provided.
  • Refunds are processed back to the user’s FastCloud account unless eligible for PayPal or PayNow reimbursement.

Cancellations:

  • Customers may cancel accounts via FastCloud’s members area, requiring 5-day notice before billing date. Cancellation policies include non-refund clauses unless specified otherwise.

Agreement:

  • FastCloud may update terms with online notice. Continued use indicates acceptance.
  • This agreement will auto-renew unless cancelled in writing prior to the renewal date.
